Definition
Section 337 authorizes the US International Trade Commission to investigate and remedy unfair acts in the importation of articles into the United States — most commonly patent infringement. The remedy in a Section 337 case is an exclusion order, not a duty. There are three forms: a Limited Exclusion Order (LEO) blocks specific respondents' articles; a General Exclusion Order (GEO) blocks any infringing article regardless of source; a Cease and Desist Order (CDO) prevents named respondents from selling already-imported inventory. Exclusion orders are enforced by CBP at entry. Unlike duties, Section 337 remedies are binary — articles either enter or they don't. The USITC publishes orders in the EDIS system.
